2009 Official Rules

 

No Purchase Necessary. MAKING A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING A PRIZE.  Void Where Prohibited.

 

1.      HOW TO ENTER:  Visit www.mysears.com  (“Website”), follow the onscreen instructions to become a registered user of the Website, and follow the onscreen instructions to participate.  The “MySears.com Wishbook Scavenger Hunt Sweepstakes” (“Sweepstakes”) begins at 12:01 AM Central Time on November 18, 2009 and ends at 11:59 PM Central Time on December 15, 2009, 2009 (“Entry Period”).  Not responsible for lost, late, damaged, misdirected, illegible or incomplete entries, all of which are void.   Each Wednesday during the Entry Period, a Sponsor representative will start a new Website discussion thread which will explain how to participate in the weekly Wishbook online scavenger hunt by finding four (4) items from http://wishbook.sears.com/1C4ae1e53c60046938.cde.  Each Friday during the Entry Period, a Sponsor representative will post a Website discussion thread message with a bonus round online Wishbook scavenger hunt question.  Only those entrants who answer the Wednesday online scavenger hunt will be able obtain an additional entry into the weekly drawing by answering the Friday online scavenger hunt bonus question.  Entrants will be required to submit all answers privately to Molly Lipsitz (SHC-MollyL) via the Website’s private comment feature.  Answers that are incomplete or are not sent via the Website’s private message feature will be deemed void.  Limit one regular entry (in response to the Wednesday scavenger hunt question) and one bonus entry (in response to the Friday scavenger hunt question) per person per week during the Entry Period.

 

In the event of dispute over the identity of a potential winner, online entries will be deemed made by the authorized account holder of the email address submitted at the time of entry, and the potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of the email address submitted upon entry. "Authorized account holder" is the natural person who is assigned to an email address by the Internet Access provider, online service provider, or other organization that is responsible for assigning email addresses.

 

Proof of emailing does not constitute proof of delivery or entry. All entries become the property of Sponsor and will not be returned to entrant. Every entry submission must be manually keystroked and/or manually entered by the individual entrant. Automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified, and transmissions from any related email or IP addresses may be blocked.

 

2.      ELIGIBILITY:  Open only to legal U.S. residents who are individuals 18 years of age or older, excluding employees of Sears Holdings Management Corporation, its respective parent companies, subsidiaries, affiliates, related companies and advertising and promotion agencies, and the families and/or household members of each of the above.

 

3.      DRAWING:  Each Tuesday during the Entry Period, a potential winner will be selected in a random drawing from among all eligible entries received during the prior week.  Valid entries received during one weekly prize drawing period will not be included during subsequent weekly entry periods.  Drawings will be conducted by a representative or designee of Sponsor, whose decisions are final on all matters relating to this Sweepstakes.  Winner does not need to be present at time of drawing; he/she will be contacted by email, telephone and/or mail in Sponsor’s sole discretion.

 

4.      PRIZE:  There will be one weekly (1) Prize, consisting of a $100 Sears electronic gift card.  Approximate Retail Value (ARV) of each Prize:  $100.   ARV of all prizes:  $400.  Gift card restrictions may apply.  Odds of winning depend on number of eligible entries received prior to drawing.  Limit one Prize per household.  Prizes won by minors will be awarded in minor’s name to a parent or legal guardian, who will be required to sign all required documents. 

 

5.      PRIZE ACCEPTANCE:  By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are final in all respects.  Prizes are not transferable. Taxes on Prize are sole responsibility of winner.  No Prize substitutions or cash redemptions allowed except by Sponsor, who may substitute a Prize of equal or greater value if advertised Prize becomes unavailable.  Winners may be required to sign an affidavit of eligibility/release of liability and publicity (where permitted) within a time period designated by Sponsor, or Prize may be forfeited.   If potential Winner cannot be reached, if he/she is found to ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize or prize notification or any prize correspondence is returned as undeliverable, potential Winner may be disqualified and an alternate may be selected from the remaining eligible entries at Sponsors’ sole discretion.  By accepting Prize, winner consents to use of name and likeness for advertising purposes worldwide without limitation and without additional compensation, except where prohibited by law.  By accepting prize, winner further agrees to release Sponsor and its parent companies, subsidiaries, affiliates, related companies and advertising and promotion agencies, and each of their respective officers, directors, employees and agents from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Sweepstakes or with respect to awarding, receipt, possession, use and/or misuse of any Prize.  Sponsor is not responsible for any typographical or other errors in the printing, the offering or the announcement of any prize of the promotion.

6.      INTERNET:   By participating, entrants hereby agree that Sponsor is not responsible for incomplete, lost, late, damaged, illegible, misplaced or misdirected email entries or faulty transmissions, technical computer hardware or software failures of any kind, lost or interrupted or unavailable network connections, or failed, incomplete, garbled, misrouted, scrambled or delayed computer transmission or other errors or problems of any kind, whether mechanical, human, electronic or otherwise, which may limit a user's ability to participate in the Sweepstakes. Entrants further agree that Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty, failed, garbled or jumbled electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Sweepstakes; or, (d) inaccessibility or unavailability of the internet or the website or any combination thereof; (e) any injury or damage to participants or to any other person's computer which may be related to or resulting from any attempt to participate in the Sweepstakes or download any materials in the Sweepstakes.

Sponsor reserves the right to (1) disqualify any entrant and void any entries of an entrant who has engaged in unsportsmanlike conduct, fraud or other misconduct relative to this Sweepstakes or otherwise attempted to tamper with or impair the Sweepstakes, and to (2) cancel, modify, suspend or terminate the online portion of the Sweepstakes if, in Sponsor's sole opinion, technical failures, applicable laws or regulations, virus, bugs, unauthorized human intervention or other cause destroys the integrity of the Sweepstakes or otherwise corrupts or impairs the administration, security, legality, fairness or proper play of the Sweepstakes or any part thereof.

Sponsor also reserves the right at its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes or the website, or to be acting in any manner Sponsor deems to be in violation of the Official Rules or disruptive, or with intent to annoy, abuse, threaten or harass any other person. If, for any reason, the Sweepstakes is not capable of running as planned for any reason, including without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, violation of applicable law or regulation or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes or for any other reason, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part.

Eligibility: Sears  Review Writing Giveaway Sweepstakes (the “Sweepstakes”) is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry.  Employees of Sears Holdings Management Corporation, Viewpoints Network, its parents, affiliates, agents, and  advertising and promotion agencies, and their respective immediate family members (spouse, children, parents and siblings) and those living in the same household of each (whether or not related), are not eligible to enter. Void where prohibited.

Two ways to enter: (1) Online: When you submit a “qualifying product review” (as defined below) in any category on www.MySears.com (“Website”) between 12:01 AM Eastern Standard Time on September 24, 2009 and 11:59 PM Eastern Standard Time on October 7, 2009, you will be automatically entered in the Sweepstakes and eligible for the drawing conducted after the Sweepstakes end date.  By entering, you agree that your entry will comply with Sponsor’s Terms of Use, found at http://www.mysears.com/terms_of_service. (2) By U.S. Mail: Hand-print your complete name, age, complete address (including ZIP Code), phone and email address (optional) on a plain 3"x5" paper and mail it in a hand-addressed #10 envelope with first class postage affixed, to: Sears Review Writing Sweepstakes, c/o Viewpoints Network, 222 West Hubbard, Suite 310, Chicago, IL 60654 . Upon receipt of your mail-in entry, you will be automatically entered in the Sweepstakes. Entries must be postmarked by  October 7, 2009 and received by October 14, 2009 to be included in the Sweepstakes drawing. Mechanically produced entries are not eligible.

A “qualifying product review” must meet all of the following requirements:

1.          Each product review must be of a product included in the Website product catalog.

2.           Each product review is subject to editorial review by Sponsor and/or its designees.

3.           If the product is being reviewed for the first time, all review fields marked as mandatory on the Website must be completed.

4.           Content of the review must be relevant to the product being reviewed.

5.           The review must not contain profanity or other inappropriate content.

6.           Each review must be original content and uniquely created for Sponsor and cannot be copied from any other source.

7.           Each product review must be a minimum of 500 characters in length (about 85 words).

 

In the event of dispute over the identity of a potential winner, online entries will be deemed made by the authorized account holder of the email address submitted at the time of entry, and the potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of the email address submitted upon entry. "Authorized account holder" is the natural person who is assigned to an email address by the Internet Access provider, online service provider, or other organization that is responsible for assigning email addresses.

Proof of emailing does not constitute proof of delivery or entry. All entries become the property of Sponsor and will not be returned to entrant. Every entry submission must be manually keystroked and/or manually entered by the individual entrant. Automated and/or repetitive electronic submission of entries (including but not limited to entries made using any script, macro, bot or sweepstakes service) will be disqualified and transmissions from any related email or IP addresses may be blocked.

Random Drawings. One (1) Grand Prize winner will be selected from among all combined eligible entries in a random drawing conducted on or about October 15. All drawings will be conducted by Sponsor (or its designee), whose decisions are final on all matters relating to this Sweepstakes. Odds of winning depend on the number of eligible entries as of the date of each such drawing.

A potential winner, along with ten alternate potential winners, will be selected in a random drawing, from all eligible entries received.  The drawing will be conducted by Sponsor or its designee, whose decisions are final and binding on all matters relating to the Sweepstakes.  Potential winner does not need to be present at time of drawing; they will be contacted by phone and/or email. In order to win, the potential winner must: (i) comply with all requirements set forth in these rules; and (ii) except where prohibited by law, sign and return an Affidavit of Eligibility and Release from Liability, which will be provided by Sponsor, within the time period designated by Sponsor.  If the potential winner does not meet the above requirements, or is otherwise disqualified, then the first alternate potential winner will become eligible to win the Grand Prize.  If, for any reason, the first alternate potential winner does not meet the above requirements, or is otherwise disqualified, then the remaining alternate potential winners will each, in turn, become eligible to win the Grand Prize until an alternate potential winner complies with the above criteria.

Prizes and Approximate Retail Values: One (1) Grand Prize will be awarded, consisting of a $500 Sears gift card.  Approximate Retail Value of Prize:  $500. 

Miscellaneous: By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor, which are final in all respects. No cash or other substitution or transfer of prizes permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value due to prize unavailability due to circumstances beyond its control.
