Product Reviews 2009 Official Rules

 

For the purposes of brevity, Sears Holdings Corporation, its units and affiliates including but not limited to MySears.com and MyKmart.com will be henceforth referred to as Sears in the document.

 

No Purchase Necessary.  Void where prohibited. 

By participating in this promotion, you agree to these official rules:

1. Entry: Entries can be submitted on MySears.com or MyKmart.com beginning June 15, 2009 (12:01 AM Central time) through July 12, 2009 (11:59 PM Central time). The incentives will be determined on a weekly basis and entries from prior week will not be considered for selection in the subsequent weeks.

2. Selection of incentive recipients: Every week for the duration of the promotion, the winners will be selected based on the “number of eligible product reviews” written by each participant member during that week. The twenty-five (25) members who have written the most eligible reviews during the week will be delared “Winners”. Every Thursday for the duration of promotion MySears.com & MyKmart.com will publish a list of twenty-five (25) leading review writers for that particular week.

The Winners (and members of Winner’s household) from one of the weeks are ineligible for further weeks during the reminder of the promotion.

To be eligile, each product review must comply with following guidelines:

1) Each product review must include product name and model number correctly.
2) Each product review is subject to editorial review

3)  If the product is being reviewed for the first time- All review fields marked as mandatory on the website should be completed. If replying to a review, all given mandatory fields should be completed.
4) Content of the review must be relevant to the product being reviewed.
5) Content of the review must not contain profanity
6)  Each review must be original content and uniquely created for Sears and cannot be copied from any other online source.

7) To qualify, participants should write a minimum of 2 reviews.

 

3. Incentives: Every week for the duration of the promotion twenty-five (25) members who have written the most eligible reviews during the week will be delared “Winners”. The prize is a one year membership to the Shipvantage program, which is free or discounted shipping on all mailable items for one (1) year, begnning on the day the Winner accepts their prize . The Shipvantage Shipment Membership Program Tems and Conditions (“Shipvantage Terms”) can be found at the following link.  The Shipvantage terms may be modified at anytime by Sears, in its sole discretion. The Shipvantage Terms in effect at the time of order will apply, and Winner accepts the prize subject to these terms and conditions.  Taxes are sole responsibility of Winner.
The membership to shipvantage is not transferable.  Prize cannot be returned and is non-refundable.

4. Eligibility: To participate, you must legally reside in the 50 United States and be over 18 years when entering. Void in Puerto Rico and where prohibited by law.  Employees of Sears Holdings Management Corporation, its respective parent companies, subsidiaries, affiliates, related companies, advertising and promotion agencies, and prize suppliers (and the immediate family and/or those living in the same household of each such employee) are not eligible. You are also ineligible if you are a Corporate Account, someone who purchases products for business or institutional use or if you are a reseller or intend to resell any goods ordered from Sears.

5. INTERNET: Sponsor is not responsible for electronic transmission errors or hardware or software malfunctions resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials. If for any reason the Internet portion of the program is not capable of running as planned, which result in technical problems that affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Sponsor reserves the right to select winners from eligible Entries received as of the termination date.  Sponsors further reserve the right to disqualify any individual who tampers with the entry process. Caution: Any attempt by a participant to deliberately damage any Web site or undermine the legitimate operation of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to seek damages from any such participant to the fullest extent of the law.

 

 

6. GENERAL CONDITIONS: Prize is not transferable. No Prize substitution or cash
redemption allowed except by Sponsor, who may substitute prize of equal or greater value if advertised Prize becomes unavailable. All federal, state and local laws apply. If Prize is won by a minor it will be awarded in the name of his/her parent or legal guardian. Potential Winner (or parent or legal guardian if Winner is a minor) may be required to sign an affidavit of eligibility/release of liability and publicity (where permitted) within a time period designated by Sponsor, or Prize may be forfeited. By accepting Prize, Winner (or parent or legal guardian if Winner is a minor) consents to use of Winner’s name and likeness for advertising purposes in all media worldwide without limitation and without additional compensation, except where prohibited by law. Winner agrees to release Sponsor and its parent companies, subsidiaries, affiliates, sales representatives, related companies and advertising and promotion agencies, and each of their respective officers, directors, employees and agents from any and all liability, loss or damage of any kind arising out of or in connection with their participation in this Sweepstakes or with respect to awarding, receipt, possession, use and/or misuse of any Prize. Winner acknowledges and agrees that Sponsor and its agents have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize, including, but not limited to its quality, merchantability, mechanical condition, or fitness for a particular purpose. Sponsor is not responsible for any typographical or other errors in the printing, the offering or the announcement of any Prize or the Sweepstakes.

7.  Governing Law. This agreement is governed by Illinois laws as such laws are applied to agreements entered into and to be performed entirely within Illinois between Illinois residents. This agreement sets forth the entire understanding and agreement with respect to this Promotion.

Money was hard, but I knew what I bought would last.
